Police Absence Delays Pre-Trial Hearing in Bali Land Agency Investigation

The legal team for a senior land official expressed significant disappointment after the Bali Regional Police failed to attend a scheduled pre-trial hearing, forcing a postponement and raising questions about procedural respect.

DENPASAR — A scheduled pre-trial hearing at the Denpasar District Court was abruptly postponed on Friday, January 23, 2026, after the respondent, the Bali Regional Police (Polda Bali), did not appear. The absence drew sharp criticism from the legal team representing the petitioner, I Made Daging, the Head of the Bali Regional Office of the National Land Agency (BPN).

The hearing, concerning the police’s decision to name their client a suspect, was presided over by single judge I Ketut Somanasa. Lawyers Gede Pasek Suardika and Made “Ariel” Suardana, coordinating the defense, stated that all administrative procedures for the lawsuit had been properly followed. The pre-trial application was filed on January 5, a case number was issued on January 7, and summons were received by the police on January 13.

“The summons was received at the Bali Police on January 13, and the hearing was on January 23. They had 10 days to coordinate and attend, but they did not show up,” stated a member of the legal team. “This has caused the hearing to be delayed for another week.”

The lawyers interpreted the absence as a sign of disrespect for the judicial institution and a violation of proper criminal procedure. “We are, of course, deeply disappointed because it turns out the Bali Police cannot set an example for the public on how to respect the court,” one lawyer said.

They also contrasted the handling of this case with another investigation involving similar evidence, which they claimed was processed with unusual speed.

“On the other hand, a report filed on the 5th had an investigation order (Sprindik) issued by the 7th for another case with the same evidence. This is an unfair method,” they argued, suggesting inconsistent application of procedures.

The legal team emphasized that a formal notification of inability to attend would have been a basic courtesy.

“If you truly cannot attend, send a letter. State your reasons. Coming without any notice is tantamount to not respecting the judicial institution.”

They indicated they are considering further legal steps if such practices continue. The court has rescheduled the hearing for one week later.
