HEYBALI – For travelers accustomed to cannabis being legal, decriminalized, or medically prescribed back home, a case now unfolding in a Denpasar courtroom offers a sobering reality check about what those same substances mean under Indonesian law.
Prosecutors have formally requested an 18-month prison sentence for Tyeisha Kieonne Parks, a 32-year-old American woman found carrying 36.71 grams of cannabis, roughly the weight of a chocolate bar, when she arrived in Bali earlier this year. Her defense center on a claim familiar to many travelers managing anxiety: that she used cannabis therapeutically, not recreationally.
A Routine Customs Check That Changed Everything
The case began the night of April 21, 2026, when Parks landed at I Gusti Ngurah Rai International Airport with her partner, Joshua Anania Murphy, just before 11 p.m. At the international arrivals terminal, Parks filled out a standard customs declaration form, known as BC 2.2, with her partner’s assistance. She did not declare any narcotics.
What followed was routine airport screening that many travelers pass through without a second thought. Customs officers ran her luggage through an X-ray machine and flagged something suspicious inside her suitcase.
The subsequent physical inspection, conducted at the Ngurah Rai customs office, uncovered a clear plastic bottle labeled “Peach Crescendo” containing 13.88 grams of dried green-brown plant material, along with a separate clip-seal bag holding another 22.83 grams. Lab testing confirmed both contained Delta-9 tetrahydrocannabinol, THC, the psychoactive compound in cannabis. Combined, the two containers held 36.71 grams, along with a metal grinder and rolling papers found in her possession.
Prosecutors Built Their Case Around Article 127, Not Trafficking
Public prosecutor Ni Putu Eriek Sumyanti charged Parks under Article 127, paragraph 1(a) of Indonesia’s 2009 Narcotics Law, the provision specifically covering personal drug use rather than distribution or trafficking. Prosecutors were explicit in stating they found no connection between Parks and any narcotics network, domestic or international, and that her trip to Bali was purely for tourism.
That distinction matters significantly under Indonesian law. Trafficking charges in Indonesia can carry sentences ranging from years to decades, and in extreme cases, capital punishment. Personal use charges, by contrast, carry far lighter penalties, though “far lighter” in this context still means a prison sentence measured in years, not a fine or a warning.
A Medical Anxiety Claim, Testified to via Zoom From Ohio
Central to the case was testimony about Parks’s mental health history. In an earlier hearing, her treating clinician, Michael Hodge, a certified nurse practitioner specializing in psychiatric mental health, testified remotely via Zoom from Ohio.
Hodge told the court that Parks had struggled with cannabis use disorder alongside severe depression for approximately two years, describing her condition as difficult to manage and accompanied by significant anxiety. According to his testimony, Parks had previously been recommended cannabis use as a way to ease her anxiety symptoms, a treatment approach increasingly common in parts of the United States where medical cannabis is legal, but one that carries zero legal weight in Indonesia.
Parks herself told investigators she had brought the cannabis for personal use, connecting it to both her anxiety and chronic lower back pain she has experienced since 2021.
Cooperation Noted, But Bali’s Reputation Cited as an Aggravating Factor
Prosecutors acknowledged several mitigating factors in building their sentencing request. Parks was described as cooperative and respectful throughout proceedings, acknowledged wrongdoing, expressed remorse, had no prior criminal record, and stated she would not reoffend.
Yet prosecutors also cited an aggravating consideration that speaks directly to how seriously Indonesian authorities treat drug cases involving foreign visitors: the potential damage such incidents cause to Bali’s image as an international tourist destination.
The case now moves to its defense phase, with Parks’s legal team scheduled to present their plea on Thursday, August 27, before judges issue a final ruling.
For the millions of international visitors who pass through Bali each year, many arriving from jurisdictions where cannabis possession draws little more than a fine, Parks’s case is a pointed reminder that Indonesian law makes no such distinction. There is no medical exemption, no small-quantity leniency, and no allowance for cannabis obtained legally elsewhere. Under Indonesian law, THC in any form remains a Class I narcotic, and airport X-ray machines are not lenient about intent.
