DENPASAR, Bali — Lawyers representing Reiner Sugata Liman (RSL) have rejected calls to halt an ongoing criminal investigation linked to a dispute surrounding the birth of his child, arguing that the case has already passed through a lengthy legal process and should be allowed to proceed.
The statement comes after lawyers for Karina Chandra (KC) recently requested that Denpasar Police terminate the investigation through the issuance of a Surat Perintah Penghentian Penyidikan (SP3), Indonesia’s formal order to discontinue a criminal case.
Speaking during a press conference in Sanur on Tuesday evening, attorney AA Ngurah Alit Wirakesuma said the investigation did not arise suddenly but evolved from an earlier public complaint that was reviewed before being upgraded into a formal police report.
“Not every request for an SP3 must be granted. This case went through a long process before becoming a police report and has followed the proper legal mechanism,” Alit said.
According to Alit, questions first emerged during earlier civil proceedings between the couple. He claimed that KC’s lawsuit did not disclose that she was pregnant at the time, a fact that later became one of the issues raised by his client.
“Our question is why the pregnancy was not mentioned in the lawsuit. That was one of the factors that raised concerns and prompted further legal scrutiny,” he said.
Alit stated that his client initially preferred not to pursue criminal proceedings. However, he said concerns remained unresolved during the civil case, leading the legal team to continue with the police report.
“If the issue had been adequately addressed during the civil process, we might not have proceeded further. But because there were no substantive changes, the report continued,” he said.
He also emphasized that the criminal allegations were not submitted lightly and that legal elements had been reviewed before the complaint was filed.
“In criminal law, what matters are facts and evidence. If the other side wishes to challenge the process through a pretrial motion, that is their legal right,” Alit added.
Attorney Sonny Tumbelaka, who also represents Reiner, urged all parties to allow the legal process to run its course and cautioned against turning the dispute into a public spectacle.
He further indicated that legal action could be considered if statements made publicly were deemed to exceed the substance of the case and cause harm to his client.
“If there are public statements that go beyond the actual dispute and negatively affect our client, we will evaluate the appropriate legal steps,” Sonny said.
Earlier Calls for the Investigation to Be Dropped
The latest response follows a request made by KC’s legal team, led by attorney Siti Sapurah, who recently asked Denpasar Police to conduct a special case review and consider terminating the investigation.
The defense argues that the case does not meet the legal elements required under Article 401 of Indonesia’s Criminal Code, which concerns the concealment or falsification of a person’s origins.
According to KC’s lawyers, the child was delivered at a different hospital than originally planned because of an emergency medical situation that required immediate treatment at the nearest available facility.
They further maintain that there was no attempt to alter, conceal, or falsify the child’s identity and argue that the dispute is more appropriately viewed as a family conflict rather than a criminal matter.
As of publication, Denpasar Police have not publicly announced whether the request for a special case review or termination of the investigation will be granted.
The investigation remains ongoing.
